This Privacy Policy is effective as of April 2019. It was most recently updated in April 2022.

Applied Psychological Techniques, Inc., d/b/a APTMetrics (“APTMetrics”, “we”, “our” or “us”), owns and operates aptmetrics.com (the “website” or “site”) for the purposes of prospect, partner and client communications, marketing and support. This policy addresses the use and management of data collected through this website, which includes names, company names, email addresses, job titles, addresses, phone numbers, and IP addresses.

All data, regardless of the country of origin, is transferred to, processed and stored in the United States. Data may also be accessed or used globally where authorized by clients or APTMetrics associates providing services where the clients are located.

APTMetrics is compliant with applicable data privacy and security regulations.

Privacy Statement

The privacy of individuals visiting the website is of paramount importance. We understand the need of protecting personally identifiable information and we have established this privacy policy (the “Policy”) with respect to all information collected via the website. This Policy sets forth our policies regarding the collection, use and disclosure of certain information relating to the website.

These privacy principles apply when APTMetrics collects and processes personal information directly from the person whom the data identifies, or indirectly from someone else, such as an employer or marketing partner.

During Visits to the Website

We may collect personally identifiable and non-personally identifiable information from you. Personally identifiable information includes information that identifies you as a specific individual or that would allow or facilitate contact with you online or offline; for example, your name, location, email address, or other information. Non-personally identifiable information includes such information as your age, years of experience, and occupation.

The information we collect via the website will be transferred to the United States and processed there. In the event that you need to correct, amend, or delete information that is inaccurate, you should do so via the website. In the event you are unable to access such information, you may request correction, amendment or deletion of personal information by us, and we will make an effort to assist you, except where the burden or expense of providing access is disproportionate to the risks to your privacy, or where the rights of others would be violated.

When you visit the website, we may also collect certain information about your visit. For example, our servers may identify your Internet Protocol (“IP”) address, the type/brand/version of your browser and operating system, and what pages of the site you visit.

Use of Information

We collect such information to, among other things, track the number of visitors to different areas of our website. Such tracking helps us make the site more useful to visitors, and easier to navigate. We also collect this information to evaluate how users use the site, to allow you to communicate with us more easily, to determine traffic on the site, to track the number of pages viewed collectively and by individual users, to monitor the time users spend on the site and/or on individual website pages, to log a user’s originating geographical area, to troubleshoot user issues, and to conduct standard site administration. We may preserve the logs and records pertaining to your access and use of the site indefinitely and use them at any time and in any way necessary to analyze site use, prevent security breaches, to ensure integrity of data stored on our server or in any other manner we deem necessary or desirable.

The website uses “session cookies” to maintain the security of the site.  A “cookie” is a small text file that is sent by our server to your computer.  A “session cookie” is temporary and is deleted when you close your browser.

Sale of Personally Identifiable Information

APTMetrics will not sell, rent, trade or share personally identifiable information to any third party for their promotional purposes.

Customer Service

APTMetrics communicates with users on a regular basis to provide requested services and address issues about their account. We reply via email or phone, as appropriate.

Consent to Marketing

By submitting a contact form or all other forms accessible from our website, users consent to us emailing them, collecting their personal data, and processing that information in the provision of services and for the purposes of marketing and research. A link is provided with each form to make users aware of their rights and the ways in which their data will be used as referenced in this Privacy Policy.

Users have the right to revoke this consent at any time.

Disclosures Required by Law

APTMetrics reserves the right to disclose any information concerning you, without limitation, to (a) conform to the requirements of law or to comply with a legal process or law enforcement investigation; or (b) protect and defend the legal rights or property of APTMetrics, our websites or their use. APTMetrics further reserves the right to release any information concerning you if you are involved (or are reasonably suspected by APTMetrics of being involved) in any illegal activity, even without a subpoena, warrant or court order.

Third Party Services

APTMetrics reserves the right to hire third party service providers to assist us in operating and maintaining the website and to process data received via the website. APTMetrics may disclose or share certain information necessary for the third party to perform these services. These third party service providers do not retain, share, store or use personally identifiable information for any secondary purpose.

Security

The website contains systems and procedures intended to prevent unauthorized access to user information as well as to protect against loss, misuse and unauthorized access, disclosure, alteration and destruction of personal information. All information entered on or through the website is protected by secured access  and APTMetrics’ security processes. Although APTMetrics takes reasonable precautions to protect users’ information, due to the open nature of the Internet, APTMetrics cannot guarantee that any information stored on our servers, or transmitted to or from a user will be free from unauthorized access. By using the website, you acknowledge that you understand, agree to and assume these risks.

Google reCAPTCHA

reCAPTCHA, a Google service, is a CAPTCHA system that enables web hosts to distinguish between human and automated access to websites. It protects websites from spambot abuse.

This website is protected by reCAPTCHA, and the Google Privacy Policy and Terms of Service apply.

Links

The website contains links to external sites. APTMetrics is not responsible for the privacy practices of such other sites. Visitors must be aware when they leave our website.

Right to Know and Data Portability

You have the right to request that APTMetrics disclose certain information to you about our collection and use of your personal information over the past twelve (12) months (the “right to know”). Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

Right to Delete

You have the right to request that APTMetrics delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) or your Employer to:

  • Complete the transaction for which we collected the personal information, take actions reasonably anticipated within the context of our ongoing relationship with you, fulfill the terms of a contract with the Employer.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us or the Employer.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided the information.

APTMetrics will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our subcontractors and other third-party service providers to take similar action.

Exercising Your Rights to Know or Delete

To exercise your rights to know or delete described above, please submit a request by emailing APTMetrics at help@aptmetrics.com.  Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may submit a request to know only twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

APTMetrics cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  You do not need to create an account with us to submit a request to know or delete. We will use personal information provided in the request only to verify the requestor’s identity or authority to make it.

APTMetrics endeavor to substantively respond to a verifiable user request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.  We will deliver our written response to that account. If you do not have an account with us, we will deliver our response by email (to the address on file).  Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

APTMetrics will not discriminate against you for exercising any of your rights under the terms of this policy or any applicable law(s), and we will not provide you a different level or quality of or services as a result.

Reorganization

APTMetrics may transfer, sell or assign information concerning your use of the website, including without limitation, personally identifiable information, to a third party, as a result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of APTMetrics.  In the event of such a transfer the third party shall provide at least the same level of privacy protection as is required by this policy.

Changes to this Policy

This Policy is effective as of the date shown above. APTMetrics reserves the right to change or amend this Policy at any time. It is our policy to post any changes we make to our privacy policy on this page. The date this policy was last revised is identified at the top of the page. Your continued use of our sites following the posting of such changes or amendments constitutes your acceptance of such changes.
